We, the undersigned citizens, taxpayers, and registered voters of the State of Michigan, do hereby respectfully petition you

1) to demand that the Board of Regents of Eastern Michigan University forthwith cancel the exit agreement they signed with the former President of the University, Samuel A. Kirkpatrick, and freeze all unpaid funds thereunder. Failing the Board's immediate compliance with this demand, you and the Attorney General of the State of Michigan should take without delay any and all available and appropriate action to effect such cancellation and freeze; and

2) to request the immediate resignations of Philip A. Incarnati, Chair of the Board of Regents, and Joseph E. Antonini, Chair of the Finance Committee of the Board of Regents, for misfeasance and malfeasance in public office. Any failure to comply with your request for these resignations should cause you to invoke your constitutional authority to remove these two individuals from the Board.

This citizen petition is based upon the Performance Audit of the University House Project at Eastern Michigan University released July, 2004, by the Office of the Auditor General which confirms that significant and major breaches of the public trust, violations of state law and regulations, and shameful waste and extravagance with public funds have been committed by the Board of Regents, with or without the encouragement, complicity, or assent of former President Kirkpatrick.
